Terms of use and privacy policy

1. Validity

1.1. By installing and using the application “HALE Fiscal Slovenia” the user agrees with the  terms of use in the currently valid version.

1.2. By installing the application the usage relationship between HALE electronic GmbH and the user shall commence. The usage relationship is established for an indefinite period.

1.3. By installing and using the application the user explicitely agrees that the data, which are entered or automatically transferred by the taximeter, are recorded on the mobile device and electronically transmitted to fiscal authorities.

2. Use of the application

2.1. The application enables the user to store taximeter data and/or fares as well as relevant additional information on the mobile device, to encrypt the data by means of a certificate and to transfer them electronically to fiscal authorities. Subsequently, based on the data a receipt is generated.

2.2. Users can access the application by installing it on their mobile device. For using the application it is necessary to enter a tax ID, a Cab ID, an electronic device ID and the certificate issued by the fiscal authorities.

2.3. HALE electronic GmbH provides the HALE Fiscal Slovenia application free of charge. However, in connection with the use of the mobile application there arise costs at the respective network operator due to the transfer of data to the fiscal server.  These costs have to be borne by the user. A guarantee for an uninterrupted availability of the application, the fiscal server or the communication with the taximeter and/or printer can not be given.

 2.4. The user must not modify, disassemble, decompile, reassemble, publish, copy, reproduce or duplicate the application.

3. Liability

3.1. Any compensation and liability for damage (material or immaterial damage, lost profit, financial penalties), which is caused or alleged to be caused by the use or disuse of the application or the use of faulty and/or incomplete information is strictly excluded.

3.2. HALE electronic GmbH does not assume any warranty or guarantee (neither express nor implied) for the suitability of the application for a particular purpose or for its compliance with customer’s specific requirements or expectations.

4. Privacy policy

4.1. The use of the application is possible without providing personal data (for instance name or address). Relevant operational data (such as fare or extras), however, are transmitted to fiscal authorities.   

4.2. We would like to point out, that the data transmission via the mobile network may have security vulnerability. A complete protection of the data against access by third parties is not possible.

5. Scope of application and amendments

5.1. HALE electronic GmbH reserves the right to adapt and alter the terms of use at any time.

5.2. The terms of use are subject to Austrian law, application of CISG (UN Convention on Contracts for the International Sale of Goods) is excluded. Austrian law applies to all legal relations between the parties resulting from the use of the application. Exclusive court of jurisdiction ist Salzburg.
